Privacy Policy

This privacy policy describes the rules by which VU INC and its Affiliates process Personal Data of Users through the website vusecurity.com.

1. Definitions

  • Affiliate: Means a company controlled by, under common control with, or that controls VU. Control is characterized when the controlling company owns fifty percent (50%) or more of the share capital of the controlled company.
  • Consent: Means any freely given, specific, informed, and unambiguous indication of the User's wishes by which they accept, either by a statement or a clear affirmative action, the processing of Personal Data concerning them.
  • Personal data: Means information of any kind referring to identified or identifiable natural or legal persons.
  • Sensitive data: Means Personal Data revealing racial and ethnic origin, political opinions, religious, philosophical, or moral convictions, trade union membership, and information concerning the health or sex life of a person.
  • User: Means any natural or legal person to whom VU provides the Service and whose personal data is processed.

2. User Consent

By accepting this Privacy Policy, the User grants consent for VU to process their Personal Data.

The User understands and accepts that they may withdraw their consent at any time by submitting a request to the Data Protection Officer at: dpo.vu@vusecurity.com.

This Privacy Policy applies to the processing of User's Personal Data by VU and its Affiliates; consequently, the Personal Data processed under this Privacy Policy may be shared with VU's Affiliates.

3. Data Controller

VU is the data controller for the processing of User's Personal Data through its Affiliates in accordance with this Privacy Policy.

VU has a Data Protection Officer (DPO) responsible for compliance with personal data protection regulations, who can be contacted at: DPO.VU@vusecurity.com

4. Purpose of Processing

The User understands that Personal Data is processed for the following purposes:

  1. Maintenance, management, analysis, development, and improvement of the Site.
  2. Authorizing and managing access to the Site, verifying identity, authenticating visits, and providing the Service to the User.
  3. Analysis of browsing behavior and profiling based on preferences and interests.
  4. Handling inquiries made through the Site.
  5. Dissemination of VU's activities.
  6. Offers and/or advertising of VU products.
  7. Access to the Site and its improvements.
  8. Diagnosis of potential connectivity issues to improve access.
  9. Updates to the Privacy Policy.

If Personal Data is to be used for purposes other than those expressed here, VU will communicate this to the User prior to processing in order to obtain Consent.

5. Personal Data Processed

Mandatory User Personal Data for access to the Site and its proper functioning:

  1. First and last name.
  2. Email address.
  3. Personal identification number.
  4. Contact information (phone number, address, country of residence, etc.).
  5. Geolocation.

Additionally collected: information about User activity and preferences on the Site, the ISP domain name, date and time of access, and the internet address from which the link to the Site originated.

6. Personal Data Storage

Personal Data collected by VU will be retained for the period determined based on the following criteria:

(i) legal obligation of retention; and (ii) request for deletion and/or objection to processing by the User in applicable cases.

Once any of the established periods have concluded, Personal Data will be deleted in such a way that the User cannot be identified.

7. Assignment and Transfer of Personal Data

The User understands that their Personal Data may be shared with:

- Third parties providing services to VU and/or its Affiliates (acting as data processors). - VU's Affiliates, for the same purposes stated in this Policy.

If there is a legal obligation or requirement, VU may disclose Personal Data to the corresponding authorities.

The User accepts that VU may transfer Personal Data outside the User's country of residence through International Data Transfers. VU uses standard contractual clauses in accordance with international regulations and commits to adopting the necessary organizational, technical, and contractual measures to ensure the protection and security of Personal Data.

8. User Rights

The User may exercise the following rights:

  1. Withdraw consent granted.
  2. Access their Personal Data.
  3. Rectify their Personal Data.
  4. Delete or suppress their Personal Data.
  5. Limit the processing of their Personal Data.
  6. Object to the processing of their Personal Data.
  7. Data portability.

These rights may be exercised by the User or their legal representative, through written communication addressed to DPO.VU@vusecurity.com

9. Exceptions

VU may disclose certain User Personal Data when necessary to:

  1. Avoid legal liability.
  2. Comply with a legal requirement (search warrant, subpoena, or court order).
  3. Comply with a requirement from a governmental or regulatory authority.
  4. Protect the rights, property, or safety of VU, Users, or a third party.

10. Information the User Chooses to Share

Users may access third-party services through links from the Site. VU is not responsible for the privacy policies and/or practices of these third-party services. The User is responsible for reading and understanding the privacy policies of such services.

VU may communicate with Users through automatic notifications, email, SMS, MMS, or other text messages, and may collect information about such communications to improve Services.

11. Confidentiality and Security

VU adopts reasonable security measures to protect Personal Data and prevent unauthorized access, modification, disclosure, or unauthorized destruction. Information is treated confidentially and access is restricted to VU employees, contractors, operators, and representatives who need such access.

VU requires its providers to maintain the same confidentiality standards and does not allow access to this information by third parties outside VU. While maintaining security and incident response plans, VU cannot guarantee that unauthorized third parties may not eventually overcome security measures.

12. Minors

Registration and/or use of the Service are intended for Users who are legally capable and of legal age to contract in the country where they register. Minors are not permitted to use the services provided by VU or to provide any Personal Data.

13. Modifications

VU may update this Privacy Policy at any time and without prior notice. VU will communicate modifications to the User prior to their entry into force.
